These Terms of Service (“Terms”) govern the relationship between The Ceardach Ltd (“the Ceardach”, “we”, “us”) and you (“the Client”). By subscribing to a web design method or purchasing from our shop, you agree to be bound by these Terms.

1. The Services (The Methods)

We provide bespoke web design and maintenance services under two primary subscription models: The Mark and The Milestone. These services are provided on a recurring monthly basis. Your subscription ensures your site remains hosted, secure, and maintained according to your chosen method.

2. Change Classifications (Minor vs. Major)

To maintain the integrity of the build, we distinguish between two types of updates:

Minor Changes (The Steady Pulse): These include font adjustments, updating service bios, swapping brand colors, and managing product stock or hero images. These are included in your monthly subscription and aim for a 72-business-hour turnaround.
Major Changes (The Structural Shift): These involve structural evolutions such as designing new pages, integrating advanced features (e.g., booking systems, e-commerce stores), or altering navigation architecture. Major changes are completed within one business week and may be subject to a one-time fitting fee or additional charge. For a full list of developments considered "Major," please contact our team.

3. Payment & Subscriptions

Processing: All payments are processed securely via Stripe.
Billing: Subscription fees are billed monthly in advance.
Failed Payments: If a subscription payment fails, we reserve the right to suspend the website and services until the account is brought up to date.
Cancellation: You may cancel your subscription at any time with 30 days notice. Upon cancellation, the website will be taken offline at the end of the current billing cycle unless a transfer agreement is reached.

4. Intellectual Property & Platform Hosting

The Client Content: You retain full ownership of all text, images, and brand assets provided to the Studio.
The Digital Architecture: The website is built using the Framer platform. All proprietary design logic, custom components, and structural architecture created by the Studio remain the intellectual property of Ceardach Studio Ltd.
Non-Transferability: Due to the technical nature of the Framer platform, the website is non-transferable to external hosting providers or third-party accounts.
Service Termination: Termination of your monthly subscription (The Method) will result in the immediate cessation of hosting and the removal of the website from the live web. The Studio is under no obligation to provide source files or "export" the site, as the architecture is natively tied to the Studio’s professional environment.

5. The Shop (Physical Goods)

Personalisation: Orders for custom POS (Point of Sale) items or branded uniforms are final once production begins.
Exclusion of Returns: Under UK Consumer Law, the 14-day right to cancel does not apply to goods that are made to the consumer’s specifications or are clearly personalised.

6. Liability

The Studio will perform services with reasonable care and skill. However, we are not liable for any loss of profits, loss of business, or indirect losses caused by site downtime or third-party platform failures (e.g., hosting outages).

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
